The Ocean Charges, including Freight Rates, Surcharges, and Fees listed in your Rate Document, are governed by these Rate Document Terms and Conditions, together with the terms specified in your individual Rate Document and Freight Nest DPD’s prevailing governing tariffs published at www.freightnestdpd.com at the time of shipment.
In the event of any inconsistency, the following order of precedence will apply:
The Rate Document Terms and Conditions
Freight Nest DPD’s prevailing governing tariffs (except “Fixed Surcharges”) at the time of shipment
Your individual Rate Document
Except for charges marked as “Fixed”, all Surcharges and Fees listed are maximum values and are valid until further notice unless stated otherwise. They are subject to the prevailing tariff(s) published on www.freightnestdpd.com at the time of shipment.
These may include, but are not limited to:
Charges arising from service changes at your request
Contingency charges
Local or extraordinary surcharges due to external conditions
These will be detailed in Freight Nest DPD’s invoice at the time of booking confirmation, which is subject to availability of vessel, space, and equipment. All shipments are subject to the terms and conditions stated in the carrier’s Bill of Lading. Definitions of “Freight Nest DPD” and “carrier” are as described in the Bill of Lading.
Ocean Charges including Freight Rates, Surcharges, and Fees are valid from the Rate Effective Date until further notice unless a specific expiry is provided.
Freight Nest DPD may initiate renegotiation of these rates as needed. Any new agreed rates will take effect immediately unless agreed otherwise in writing.
Unless explicitly stated otherwise, your Rate Document is valid under the following conditions:
The listed Eligible Shipping Party is recognized as the actual shipping party by Freight Nest DPD.
Freight Rates, Surcharges, and Fees are applicable only if booking is made and shipment is delivered within the Rate Effective Period (see Note 1).
If an Eligible Named Account is specified, it must appear as either the Shipper or Consignee on the Freight Nest DPD Bill of Lading.
The relevant Rate Folder Number must be provided at time of booking.
All rates are subject to applicable currency exchange rates at the time of shipment. For Iran imports and exports, Freight Rates and related charges must be paid in non-US dollar currencies.
Fixed: Surcharges or Fees that do not change.
Tariff: Surcharges or Fees based on prevailing governing tariffs on www.freightnestdpd.com.
Rate Document: The binding agreement between you and Freight Nest DPD, inclusive of any updates, for carriage services.
Applicable: Surcharges and Fees that apply at the time of shipment.
B/L Release: Charges applicable only when the Bill of Lading is released from a specific location.
TBD: “To Be Determined” charges that will be calculated according to Freight Nest DPD’s tariff rules or as decided at its sole discretion when no rule exists.
Your Rate Document is confidential and must not be disclosed to competitors of Freight Nest DPD.
These Terms & Conditions are governed by and construed in accordance with English Law.
Both parties agree to comply fully with the General Data Protection Regulation (GDPR) 2016/679 and any applicable data protection laws. You are considered the “Data Controller,” and Freight Nest DPD is the “Data Processor.”
By accepting this agreement, you:
Authorize Freight Nest DPD to process personal data required for fulfilling the contract of carriage.
Acknowledge that personal data may be transferred to affiliated entities, regulatory bodies, or outside the EEA in accordance with Model Clauses or Ad Hoc Clauses.
Rates are valid within the Rate Effective Period only if:
Booking is made within the Rate Effective Period, and
Shipment is delivered within that same period.
A shipment is considered “delivered” when the full Bill of Lading quantity has been received, and the time of shipment aligns with Freight Nest DPD’s governing tariff (Freight Nest DPD-100 T-2).
